NESHANNOCK TOWNSHIP BURNING ORDINANCE 1997-2 AMENDING THE NESHANNOCK TOWNSHIP BURNING ORDINANCE, BEING ORDINANCE #1969-1, AS AMENDED 1987-5.
AN ORDINANCE REGULATING BURNING IN NESHANNOCK TOWNSHIP, LAWRENCE COUNTY, PENNSYLVANIA REQUIRING PERMITS IN CERTAIN INSTANCES AND PROVIDING PENALTIES FOR VIOLATIONS.

It is illegal for any person to kindle or maintain a bonfire or any other fire on a private road, alley or land within the Township for the purpose of burning paper, straw, shavings, wood, leaves, rubbish, grass, weeds or any substance without obtaining a permit for the burning of said materials.
It is illegal for any person to kindle or maintain a bonfire or any other fire on a private road, alley or land within the Township for the purpose of burning any garbage, tires, roofing materials and any other materials which cause offensive smoke or odors.
All permits will be issued by the Supervisors or a designated representative. Permits will have a time frame. Permits will not be transferable. Any changes in the occupancy require a new permit. Permits will be charged a fee set by the Supervisors.
Only Single Family Dwellings can burn outside in approved containers. Commercial establishments cannot burn outside. Burning or Bonfires are permitted on Saturdays from dawn until 4:00 PM or specified times set by Supervisors. No burning on week days, Sundays or holidays.
All fires including incinerators must be put out not to cause smoke or odors after permitted hours. No fire shall be permitted within 15 feet of a structure. No fire shall be started unless permittee has manpower or equipment to extinguish the fire for any reason. Fires must be attended by an adult person. No fires can be started when wind or other factors cause a dangerous condition.
Supervisors, upon the recommendation of the Fire Chief of the Neshanock Volunteer Fire Company can grant special permits for clearing and grubbing of land. Burning of leaves, tires, roofing material, rubber, petroleum products, or flammable liquids is always prohibited under all circumstances.
Burning must occur in an approved container. A steel 55 gallon drum is an approved container. A screen must be placed on top of the container while burning. Holes should be placed in the bottom of the container to facilitate complete burning.
Any person who violates the burning ordinance will pay a fine of $1,000.00 and court costs, including attorney fees. If payment is defaulted, may be sentenced to jail for 10 days. This Ordinance is effective January 1, 1998.
